Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the Getcoins.com.au services ("Services"), operated by BA Digital Ventures Pty Ltd (ACN 646 421 605, ABN 30 646 421 605), an Australian company registered with ASIC and regulated as a Digital Currency Exchange (DCE) by AUSTRAC.

By accessing or using the Services, you agree to these Terms, our Privacy Policy, and our AML/CTF obligations. If you do not agree, you must not use the Services.

2. Nature of the Services

Getcoins provides non-custodial crypto on/off ramp services.

We do not hold or store fiat or crypto on behalf of customers.

All transactions are processed on a one-time basis:

• Ramp On: Deposit AUD, receive AUDD or supported cryptocurrencies directly in your wallet.
• Ramp Off: Send crypto from your wallet, receive AUD in your nominated bank account.

Customers retain full control of their wallets and funds at all times.

3. Eligibility and Compliance

To use our Services, you must:

• Be at least 18 years old.
• Complete KYC verification in line with Australian AML/CTF law.
• Use only wallets and bank accounts under your control.
• Not be located in, or transacting on behalf of, persons in jurisdictions subject to sanctions or FATF high-risk countries.

4. AML/CTF Obligations

Getcoins complies with the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).

• We conduct KYC, KYT, and ongoing transaction monitoring.
• Suspicious Matter Reports (SMRs) and Threshold Transaction Reports (TTRs) are filed with AUSTRAC as required by law.
• Customer data and transaction records are retained for 7 years.

5. Transactions

Once a transaction is broadcast to the blockchain, it is final and irreversible.

Customers are solely responsible for the accuracy of wallet addresses and bank details.

We are not responsible for loss of funds due to:

• Incorrect wallet addresses.
• Compromised devices or phishing.
• Third-party fraud.

6. Fees

Service fees are displayed transparently on our website before confirmation.

Network (blockchain) fees may apply in addition to service fees.

7. Risks

By using our Services, you acknowledge:

• Cryptocurrencies are volatile and may lose value.
• Transactions may be delayed due to compliance checks or blockchain network congestion.
• Getcoins does not provide financial, investment, or tax advice.

8. Refund Policy

Refunds are only issued in limited circumstances:

• Failed KYC or rejected compliance checks.
• Payments linked to blacklisted wallet addresses.
• Fraud or scam reports where legally required.

Refunds:

• Are returned only to the original source of funds.
• May be subject to administrative fees.
• Will not apply to completed blockchain transfers.

9. Limitation of Liability

Services are provided "as is" without warranty.

Our liability is limited to AUD 100 unless otherwise required by law.

We are not liable for indirect or consequential damages.

10. Governing Law

These Terms are governed by the laws of Australia. Disputes will be resolved exclusively in the courts of New South Wales, Australia.
